Agreement to these terms
By creating an account or using KickEats (the "Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service. KickEats is made by Codenoodle ("we", "our", "us").
What the Service does
KickEats saves recipes from links, photos and your own typing, estimates their nutrition, scales them to your calorie target and walks you through cooking them. How your data is handled is described in our Privacy Policy, which forms part of these Terms.
Your account
You need an Apple or Google account to sign in, and you must be at least 13 years old. You are responsible for what happens under your account. You can delete it at any time from Settings.
Your content
Recipes, notes and photos you add remain yours. You give us a licence to store, process and display them so the Service can work, including running them through AI models to extract ingredients and estimate nutrition. Where you share a recipe link or publish a recipe to the public directory, you also allow us to show it to other people and let them save a copy; ending the share stops new views but does not recall copies others already saved.
Only share recipes you have the right to share. Recipes you import belong to their creators, and we keep the source credit attached. If you are a creator and want a recipe credited differently or removed, email us with the link and we will act promptly.
Nutrition estimates
Calories and macros are estimates computed from an ingredient database and from AI reading of your recipe. They will be wrong sometimes, and they cannot account for your specific ingredients, brands or cooking method. They are not medical or dietary advice. If you have a medical condition, an allergy or specific nutritional needs, verify the figures yourself and consult a professional.
Timers and cooking
Timers, alarms and step guidance are conveniences, not safety devices. They depend on your device's settings and notifications and may not fire. Never leave cooking unattended and never rely on the app to prevent burning, smoke or fire.
Price
KickEats is currently free. If we introduce paid features, they will be sold through Apple's App Store at the price shown before you buy, with refunds handled by Apple under Apple's policies, and we will update these Terms first. Nothing you already have will start costing money retroactively.
Acceptable use
Use the Service lawfully. Do not upload content that is illegal, infringes someone's rights or is intended to harass. Do not scrape, overload or interfere with the Service, or attempt to access other people's private recipes. Do not copy, modify, resell or reverse engineer the app except where applicable law expressly permits it. We may suspend or remove accounts or content that break these rules.
Intellectual property
The Service, including its software, name, design and artwork, belongs to us or our licensors and is protected by copyright, trademark and other laws. The ingredient database contains information from the OpenNutrition Dataset, used under the Open Database License. You get a personal, non-transferable licence to use the app; nothing transfers ownership to you.
Availability and changes
We may update, change or discontinue the Service, in whole or in part, at any time. We may also update these Terms; the revision date at the top of this page will change, and continued use after that means you accept the update.
Disclaimer of warranties
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that imports, nutrition estimates or timers will be accurate or uninterrupted.
Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of the Service, including reliance on nutrition estimates or timers. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the claim. Nothing in these Terms limits rights you have under mandatory consumer protection law.
Apple
Apple is not a party to these Terms and has no responsibility for the Service. Apple is, however, a third-party beneficiary of these Terms and may enforce them against you. Any claim relating to the app should be directed to us, not to Apple.
Governing law
These Terms are governed by the laws of the applicable jurisdiction, without regard to conflict of law principles, and without depriving you of the protection of mandatory law where you live.
